Loud mouth Lavar Ball has continued to stay in the news with his outrageous remarks and offensive comments, but has it all been a Branding technique to help his son excel?

The Franco Brothers Baller Brand vs LaVar Ball’s Big Baller Brand Details:

Word is, LaVar Ball STOLE the name Big Baller Brand from Diego and Leandro Franco, brothers who founded Argentinian streetwear and lifestyle company, Baller Brand in 2006. The brother’s are claiming that the father of UCLA product and future NBA draftee Lonzo Ball, stole the brand name by just adding “Big.”

They feel that LaVar isn’t that smart. Here is what they said:

LaVar Ball “wasn’t creative enough to create his own brand name (and) just took ours. We are a company that started from ground zero 11 years ago. We have many proofs (of photos) that we (have been) doing this way before LaVar.”

LaVar Ball first applied for the Big Ball Brand trademark in September 2016 and it became a registered trademark in March. The Balls’ signature brand, Big Baller Brand, filed for trademark on May 21, 2016, and registered Big Baller for trademark on May 8, 2017.

Here is where the Diego and Leandro Franco screwed up:

The Francos didn’t submit their filing until Wednesday.

To add to their lackadaisical ways, Therese Varndell, a partner with Virginia-based Posz Law Group, doubted the Francos would find success with their lawsuit. They want to cancel Ball’s Big Baller Brand, but it’s probably too late.

Varndell said:

“I don’t think they are going to get any sort of trademark relief. The Big Baller Brand is already registered. I don’t see what kind of damages they’d be able claim given (Ball’s) trademark. In the eyes of the law, he has a valid, registered trademark and that’s enforceable.”

The Franco brothers told USA TODAY Sports:

“We are a company that started from ground zero 11 years ago. They said they have hired legal counsel in Buenos Aires and are deliberating about how to move forward. “We have many proofs (of photos) that we (have been) doing this way before LaVar.”

The only hope now is that the Francos could seek relief under common law, but such legal efforts are costly with little chance of success, per Varndell.

Bottom line, you snooze, you loose!  Varndell said the fact they waited until last week to register — or raise any concerns over Ball’s trademark — will likely mean the Francos’ filing will be rejected.

After being turned down by all the major shoe companies, the Balls just came out with their first Big Baller Brand shoe, the ZO2.  The shoe has drawn intense coverage to the brand because of the $495 price tag.  The reason why Nike, Under Armour and Adidas turned down LaVar Ball was that he desired a co-license deal with the Big Baller Brand. Something they didn’t want to do, so The Ball family is on to mogul success building off their own name.

We have to give it to LaVar. He’s NOT stupid like the Franco brothers said. He did do the work and got the Trademark, filed and registered it. The Franco brothers dropped the ball on all of that and they started in 2006.

Our only problem with LaVar is that he is GREEDY.
